Prenuptial in the Millenial Era: Should a Millennial Couple Have One?

The short answer is 'yes.' The millennial generation couples (born 1981-1996) and post-millennial (born 1997 and forward) differ in their needs of a prenuptial in several aspects.

Millennials are marrying older than traditional couples. This means that when millennial couples marry, they are more likely to have already accumulated substantial wealth. Thus, there is a special need for a millennial prenuptial.

This practice is healthy and may certainly avoid some headaches later. (and tons of litigation paper.)

In the few states where common law marriage applies, millennial couples may live together, accumulate assets, and think that they are excluded from matrimonial laws. That is not the case and these couples should also have a prenuptial (or post-nuptial.)

When hiring an attorney to do a millennial prenuptial, the lawyer must know what financial products and assets these couples accumulate.

For example, many couples of this generation have Roth IRA investments, ETF stocks, Bitcoins, and many other assets that a traditional couple would not have.
